Terms and Conditions of Sale

1. Purpose

These terms govern the sale of the alert service offered by REYNAL Digital Services, a sole proprietorship based in Lausanne, Switzerland ("the Seller"), on PortaSplitTracker ("the Site") to any individual who signs up for it ("the User").

2. Nature of the service

PortaSplitTracker provides an email alert service signalling the availability of products at third-party retailers, based on information from those retailers' public websites. The service is a best-efforts obligation: the Seller uses its best efforts to monitor availability and notify the User as promptly as possible, without guaranteeing completeness, real-time accuracy, or continuity of the alerts.

3. Price and payment

The price is shown on the sign-up page, in the currency of the relevant market (CHF in Switzerland, EUR including VAT in France). It is a one-off payment, with no automatic renewal, granting access to the alerts for the stated duration (90 days by default). Payment is processed securely by our provider Stripe; no card data is stored by the Seller.

4. Sign-up

The User provides their email address and completes payment. Access to the service is activated upon payment confirmation; a confirmation email is sent. Alert management is done without an account, via a private link sent by email.

5. Immediate performance — no right of withdrawal

As the service is performed immediately upon activation of access, the User expressly requests its immediate performance (checkbox) and acknowledges losing any right of withdrawal from that moment — in line, for consumers residing in the European Union, with the exception for digital content and services performed immediately with their express consent. No cancellation is possible once the service has started, subject to applicable mandatory provisions.

6. Limitation of liability

The data comes from third-party sites over which the Seller has no control. These sites may at any time change their structure, restrict automated access, deploy anti-bot protections, or alter/remove stock and price information. Consequently, the Seller cannot be held liable for a missed, late, or erroneous alert, nor for a service interruption resulting from such changes or technical constraints beyond its control. Nor can the Seller be held liable for the sales, price, or stock conditions applied by the third-party retailers.

The statistical indicators shown on the site — in particular the number of units sold — are estimates computed by our own algorithms from publicly observable availability changes. The Seller has no access to the retailers' actual stock or sales figures: these indicators are provided for information purposes only, to help the User gauge market pressure, and carry no contractual value.

7. Refund

Detection guarantee: no availability detected. If no availability of the tracked product is detected by the service across the monitored points of sale, and no corresponding alert is sent to the User over their entire alert period, the price paid is refunded in full.

The refund is initiated automatically at the end of the period, with no action required from the User, using the payment method used at purchase.

This guarantee does not apply if the User deactivates their alerts or terminates the service before the end of their period.

In the event of substantial and prolonged unavailability of the service attributable to the Seller, the User may request, by writing to support@portasplit-tracker.ch, a pro-rata refund for the period during which the service was not available. This provision is without prejudice to the consumer's mandatory statutory rights.

9. Complaints

Any complaint may be addressed to support@portasplit-tracker.ch. We strive to find an amicable solution to any dispute.

10. Governing law and jurisdiction

These terms are governed by Swiss law. The place of jurisdiction is the Seller's domicile, subject to a mandatory jurisdiction in favour of the consumer.

11. Use of the Site and its data

The Site and the data it aggregates (availability, prices, history, points of sale) are provided for personal, non-commercial use. The following are prohibited without the Seller's prior written consent: the systematic or automated extraction of all or a substantial part of this data (scraping, automated querying of the interfaces), its reuse or republication, and the building of competing databases or services from the Site. The Seller reserves all rights over this database, in particular under the EU sui generis database right and the Swiss Federal Act against Unfair Competition (UCA). Technical access-limitation measures must not be circumvented.

Visits by search-engine and AI-assistant indexing robots, for referencing and recommendation purposes, remain welcome.
